Content Provider Agreement
1. Prohibited Activities
The Content Provider agrees not to engage in any activity that is illegal or otherwise violates the standards and policies of the Platform. This includes, but is not limited to, the creation, uploading, or distribution of content that:
- Infringes on any third-party intellectual property rights.
- Contains explicit or implicit threats, hate speech, or harassment.
- Involves minors or any non-consensual acts.
- Violates any local, national, or international laws and regulations.
2. Consent Requirements
The Content Provider must obtain and maintain on record written consent from all persons depicted in the content uploaded to the Platform. The consent must include:
- Consent to be depicted in the content.
- Consent to allow for the public distribution of the content and to upload the content to the Platform.
- Consent to have the content available for download by other users, if applicable.
3. Verification of Identity and Age
Content Providers need to verify their identity and age before being able to monetize their content and/or publish any kind of sexually explicit content. The Company offers verification services to ensure the authenticity of the Content Provider.
The Content Provider is responsible for verifying the identity and age of all persons depicted in the content to ensure that all individuals are adults (18 years of age or older). The Content Provider must be able to provide supporting documents for other depicted persons upon request, including:
- A valid government-issued ID for each person depicted.
- Proof of age verification conducted by the Content Provider.
These documents have to be provided to the Company before uploading any content depicting persons other than the Content Provider.
3.1 External Verification Provider
The Content Provider may use an indentification verification service provided by the Company.
The Content Provider may utilize an external service provider for identity and age verification ("Verification Provider"). The Verification Provider must be approved by the Company and must adhere to strict confidentiality and privacy standards. The Content Provider is responsible for all costs associated with the Verification Provider. The Verification Provider's results must be made available to the Company upon request.
4. Content Provider Responsibilities
The Content Provider agrees to the following responsibilities:
- To maintain accurate records of all consents and verifications required under this Agreement.
- To comply with all Platform policies and standards regarding content creation and distribution.
- To immediately remove any content from the Platform upon request by the Company if it is found to be in violation of this Agreement or Platform policies. The Company is also authorized to remove or modify content themselves without prior notice if it is found to be in violation of this Agreement or Platform policies.
5. Consent Acknowledgment
Before uploading any content to the Platform, the Content Provider must acknowledge and agree to the following terms by marking the appropriate checkbox:
- I have obtained and maintain written consent from all persons depicted in the content.
- I verify that all persons depicted in the content are adults (18 years of age or older) and have verified their identities and ages.
- I agree to comply with all Platform policies and standards regarding content creation and distribution.
6. Term and Termination
This Agreement shall commence on the date it is signed by the Content Provider and shall remain in effect until terminated by either party. The Company reserves the right to terminate this Agreement and the Content Provider's access to the Platform at any time for any reason, including but not limited to violations of this Agreement or Platform policies.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Estonia. Any disputes arising out of or in connection with this Agreement shall be resolved in the courts of Estonia.
8. Entire Agreement
This Agreement constitutes the entire agreement between the parties regarding the subject matter hereof and supersedes all prior agreements and understandings, whether written or oral, relating to such subject matter.
